SMS Terms & Messaging Terms

These SMS Terms & Messaging Terms ("SMS Terms") govern your participation in text messaging programs operated by Flowpoint Marketing, LLC d/b/a ALTITUDE by Flowpoint Marketing("Flowpoint," "ALTITUDE," "we," "us," or "our"). These SMS Terms supplement our Terms of Use and Privacy Policy. If there is a conflict between these SMS Terms and our general Terms of Use, these SMS Terms control solely with respect to the applicable text messaging program.
1. What These SMS Terms Cover
These SMS Terms apply to direct SMS messages sent by ALTITUDE to you about your request, demo scheduling, onboarding, support, account activity, or billing. They do not create consent for marketing texts by default, and they do not govern SMS campaigns sent by ALTITUDE customers to their own end users through the ALTITUDE software.
ALTITUDE customers are responsible for obtaining their own notices, consents, and permissions for messages they send through the platform. These website SMS Terms are only about direct ALTITUDE-to-you messaging.
2. How Website Opt-In Works
On this website, the reviewable opt-in path for direct ALTITUDE SMS is the Book a call / contact form. To opt in, you must:
- submit the website contact form;
- provide your mobile number; and
- check the optional SMS consent checkbox.
Free-trial signup, newsletter signup, and general website browsing do not, by themselves, create SMS consent. Calling a business or missing a call does not, by itself, create consent to receive automated text messages from ALTITUDE.
3. Message Types
If you opt in through the website form, ALTITUDE may send SMS messages related to:
- demo scheduling and follow-up;
- onboarding or setup coordination;
- customer support communication;
- billing follow-up when you request billing help; and
- follow-up related to your request or customer-initiated conversation.
Message frequency may vary depending on your request, your reply activity, and the support or onboarding workflow involved.
4. Consent Is Optional
Consent to receive SMS messages is not a condition of purchase. You can still contact ALTITUDE by email without opting in to SMS.
5. Message and Data Rates
Message and data rates may apply to messages sent to you from us and to messages you send to us. Charges are determined by your wireless carrier and your mobile plan.
6. Opting Out
You can opt out of SMS messages from an ALTITUDE messaging program at any time by replying STOP to a message from that program. After we process your opt-out request, you should receive a confirmation message and should no longer receive further text messages from that program except as needed to honor your request or as otherwise permitted by law.
Opting out of one messaging program or one number may not automatically opt you out of separate programs, numbers, or communications channels. If you later opt in again, text messaging may resume.
7. Help and Customer Care
For help with an ALTITUDE messaging program, reply HELP to a message from that program, where supported, or contact us at support@runaltitude.com.
8. Carrier Disclaimer; Delivery Not Guaranteed
Wireless carriers are not liable for delayed or undelivered messages. Actual message delivery is subject to effective transmission by your carrier or network operator and may be impacted by factors beyond our control.
We do not guarantee message delivery, timeliness, availability, or compatibility with all carriers, devices, handsets, operating systems, or jurisdictions.
9. Eligibility and Supported Regions
You must be at least 18 years old or otherwise able to form a binding agreement under applicable law to participate in our messaging programs. Messaging programs may not be available in all areas, on all carriers, or for all devices.
10. Privacy
Your use of ALTITUDE messaging programs is also subject to our Privacy Policy.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
11. Consent Records
When you submit the website contact form with SMS consent checked, ALTITUDE may store the consent language presented to you, the time of submission, the source page, and the phone number you provided in order to document consent and support compliance review.
12. Acceptable Use
You agree not to misuse ALTITUDE messaging programs, including by providing a number you do not control or have authority to use, attempting to interfere with the messaging service, or using the messaging service in violation of applicable law.
13. Changes to Messaging Programs or These SMS Terms
We may modify, suspend, or terminate any messaging program or update these SMS Terms at any time. If we make material changes, we may provide notice by updating the "Last updated" date above, posting the revised SMS Terms, or by other reasonable means.
Your continued participation in a messaging program after updated SMS Terms become effective constitutes your acceptance of the revised SMS Terms.
14. Termination
We may suspend or terminate your participation in any messaging program at any time, with or without notice, if we reasonably believe your participation violates these SMS Terms, our Terms of Use, applicable law, carrier requirements, or creates legal, reputational, or operational risk.
15. Governing Terms; Disputes
These SMS Terms are incorporated into and governed by our Terms of Use, including any applicable disclaimers, limitations of liability, indemnity obligations, arbitration agreement, class action waiver, and governing law provisions, except to the extent a specific provision in these SMS Terms applies directly to a messaging program.
